Charter Section 99 and the SoccerCity Initiative

Thank you for the legal analysis your office has provided on the SoccerCity initiative. The SoccerCity initiative proposes a 99-year lease for City property, and doesn't require a vote of the City Council to approve the lease.

Charter Section 99 states that "No contract, agreement or obligation extending for a period of more than five years may be authorized except by ordinance adopted by a two-thirds' majority vote of the members elected to the Council." This seemingly would prevent the City from entering into a 99-year lease without Council approval. No such action has been presented to the City Council. Moreover, the SoccerCity measure is an initiative not a charter amendment, so it is unclear to me how the initiative could exempt itself from a City Charter requirement.

Please provide a written analysis of whether the SoccerCity initiative complies with Charter Section 99.
